Kinward Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Kinward (“Kinward,” “we,” “us”) governing your use of the Kinward apps and services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What Kinward does

Kinward helps families protect older adults from scams by screening calls, text/picture messages, and (where connected) financial and health activity, and by sending alerts to the family. Kinward also offers related caregiving features such as blocked-number management, benefits pre-screening, and health summaries.

Important: Kinward is a safety aid, not a guarantee. It is not an emergency service, and it is not medical, financial, legal, or tax advice. Screening is automated and best-effort and may miss scams or flag legitimate activity. Always use your own judgment, and call 911 or your local emergency number in an emergency.

You are responsible for the accuracy of your account information and for keeping your credentials and devices secure. You are responsible for activity under your account and within families you manage, including the permissions you grant to other members.

4. The loved one’s device and connected accounts

Setting Kinward as the default phone or messaging app, and connecting a bank or health account, is performed on the loved one’s own device with their authentication and consent. You may disconnect accounts or unpair the device at any time within the app.

5. Third-party services

The Service relies on third parties — including authentication, bank connectivity (Plaid), health-records connectivity, telephony/messaging carriers, AI providers, and cloud infrastructure. Your use of those features may be subject to the third party’s terms, and we are not responsible for third-party services or for carrier behavior, network coverage, or whether a given phone, carrier, or health system supports a feature.

7. Health and financial information

Where a loved one connects health or financial accounts, that information is accessed under their authorization and used to provide the Service as described in our Privacy Policy. Kinward does not provide medical diagnosis or treatment, and does not provide financial, investment, or tax advice. Information shown in the app may be incomplete, delayed, or inaccurate depending on the source system; verify important details with the provider or institution.

Some features may require a paid subscription. Applicable pricing, billing, and cancellation terms will be presented at the time of purchase. Taxes may apply.

9. Intellectual property

The Service, including its software, design, and content, is owned by Kinward and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain your own content and data.

10. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will detect or prevent any particular scam, fraud, or harm.

11. Limitation of liability

To the maximum extent permitted by law, Kinward and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, money, or goodwill, arising from or related to your use of (or inability to use) the Service, even if advised of the possibility. To the extent liability cannot be excluded, our total liability is limited to the greater of the amount you paid us for the Service in the 12 months before the claim or US $100.

12. Indemnification

You agree to indemnify and hold Kinward harmless from claims and expenses arising out of your use of the Service, your content, or your violation of these Terms or of any law or third-party right, including your representations about authority and consent.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Sections that by their nature should survive termination will survive.

14. Text messages

If you give us your own mobile number in the Kinward app and agree to receive messages, we may text you a verification code and transactional service notifications about your account. We only text a number that its owner gave us, and we do not send invitations by text message. Message and data rates may apply and message frequency varies. Reply STOP to any message to opt out, or HELP for help. Mobile carriers are not liable for delayed or undelivered messages. Details are in our Privacy Policy.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date; material changes may be communicated in the app or by email. Continued use after changes take effect constitutes acceptance.

16. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules, and you and Kinward submit to the courts located in California for any dispute, except where applicable law provides otherwise.
